The Origin of Labor Relations of Scientific and Pedagogical Staff in a Higher Education Establishment
Abstract
Filling research and teaching positions (teaching staff, scientists) as well as their transfer to some other research and teaching position at a higher education establishment are preceded by selection on the basis of a competition. The elective positions of. faculty dean and department head are an exception. The competition to fill the positions of research and teaching employees with whom an employment contract is concluded for an uncertain term is held once every five years. Thus, an employment contract is a legal form of realization of labor rights of scientific and pedagogical staff in an institution of a higher education establishment. The employment relations of this category of employees, however, arise not only on the basis of employment contract. The very basis of the origin of their employment relations is much wider. It includes as obligatory competitive legal relations that the person willing to conclude an employment contract is to enter with the higher education establishment announcing the competition.
