Single Issues of the Employment Contract Conclusion: Theory and Practice
Abstract
Major relations in the sphere of non-self-employment have a legal form and arise in the form of legal relations. In the framework of a legal relation a legal entity arises as a person holding a particular subjective right. It is possible to implement this right only within the relation. A legal fact, that is an actual action or event, with which the law connects certain legal consequences is a legal basis for the relation as a whole. It is obvious that, as regards the employment relations, an employment contract is a main legal fact leading to their formation. It is a legal act, as its conclusion presupposes the expressed will of the parties aimed at establishing an employment relation.
