Features of the employment contract with the teaching staff of educational organization of higher education
Abstract
Employment contract plays an important functional role in the emergence of the employment relationship. Only an employment contract, making complete a complex real (legal) composition, formulates the final will of the subjects of employment relationship (teaching staff and educational institutions). Employment contract as a legal fact determines the contents of the employment relationship, which largely depends on the conditions under which the parties agreed at its conclusion. Besides that, the employment contract is a guarantee whereby the parties rights and obligations arising from labor law.
