Fraud in the Sphere of Entrepreneurial Activity: new preferential constituent elements?!
Abstract
The article examines, whether it is justified to include the norm regarding fraud in the sphere of entrepreneurial activity in the Criminal Code of the Russian Federation. The authors compare the texts of the applicable law and the draft law, as well as the sanction of legal norms stipulated in articles 159 and 159.4 of the Criminal Code of the Russian Federation and verify the criminological justification of the latter. They make a conclusion about the necessity to amend article 159.4 of the Criminal Code of the Russian Federation.
