Organizational and legal framework for personal data protection in consumer p2p-lending

The article gives an analyses of the nature and content of Russian laws and regulations in the sphere of personal data protection, the problems of personal data protection in the sphere of mutual lending, as well as suggesting possible measures to prevent the risks. The subject of the research is mutual p2p-lending. The purpose of the research is to develop measures to prevent illegal collection, storage, use and dissemination of personal data. The article analyzes the provisions of the Federal Law dated August 2, 2019, no. 259-FZ “On attracting investments using investment platforms and on amending certain legislative acts of the Russian Federation”, which regulates the relationship between the borrower — a legal entity or an individual entrepreneur — and the lender, and the relationships concerning consumer mutual lending, where the borrower is an individual, are not subject to the regulation of this Law. Consumer p2p-lending is considered a type of crowdlending, where borrowers and investors are individuals. The essence of consumer p2p-lending is revealed, the definition and description of the consumer p2p-lending business model, which has been developed by foreign practice, is described. The definition of personal data is considered, taking into account the peculiarities of consumer mutual lending. The article highlights the risks in the sphere of personal data protection that arise when entering into a consumer mutual lending relationship. The analysis allows to consider the existing risks more thoroughly and propose measures to minimize them. To minimize the risks that may arise during the protection of personal data in the sphere of consumer mutual lending, the main requirements for legislative acts have been taken into account and summarized, and also some additional measures have been proposed.
