Application of legal concepts for managing risks occurring upon circulation of rights at the securities market: securitization of assets

Abstract

The article analyzes the main directions of application of the concept of securities for the optimization of property rights circulation (indirect holding, issuance of derivatives, centralization of the functions as to recording and information). Securitization is used as an example of tight connection between economic concepts (models of behavior) and legal concepts (methods of regulation). It is emphasized that nowadays the human rights concept must be taken into account upon regulation of business relationships with private persons.
