History of legal regulation of concession relations
Abstract
This article represents an expanded and integrated study of development of concession relations. First of all, the issue of concession origins is considered in sufficient detail. It is connected with a buy-out which was a common practice in Ancient Greece and Rome beginning from the 5th century B.C. The author pays separate attention to the legal characteristics of the main historical stages of formation of concession legislation in Russia starting from the first concession issued by Ivan the Terrible in 1558 up to the adoption of the special legislation in the USSR concession projects of which are known as the most large-scale in the national history. Moreover, the author’s attention is focused on the legal characteristics of laws determining the legal regime of the concessionary’s activity, first of all, the guarantees which were established in the legislation. Thus, it showed the intention of the Soviet State to disperse fears to invest into the ”transition economy” of the Soviet Russia. In conclusion, the author considers the issue of using the experience of the Soviet concession legislation while improving the modern legislation on concessions.
