Problems of realization of the right to compensation for damage caused by illegal bringing to criminal responsibility

Abstract

The present article is devoted to the matters of state responsibility for damage caused by illegal bringing to criminal responsibility. Special attention is paid to the establishment and improvement of procedures for compensation payment from the federal budget; the problems people face with during implementation of the constitutional right to compensation for damage caused by the State; the correlation of this right and financial resources of the State under the operation of the legal regime of budget immunity. The author uses the wide range of Soviet and contemporary enactments and decisions of the Russian Federation Constitution Court concerning this matter.
