Some issues of legal regulation of cession and pledge of rights in the light of securitization in Russia

Abstract

Despite of a number of amendments on securities introduced into the legislation the only type of securitization in Russia which has been practiced for more than five years so far is mortgage securitization, very scanty at that. The article focusing on certain provisions of the «Conceptions of the development of civil legislation of the Russian Federation», analyses the key issues of legal regulation, prompt consideration and resolution of which, according to the author, would contribute to the development of this refinancing technique: cession and pledge of rights. The author outlines possible ways of resolution of the problems in question.
