The Concept “Group of Persons” in law of Russia and Germany: Comparative Legal Analysis

Abstract

The article presents a comparative-law analysis of key positions which are necessary and sufficient when classifying “group of persons” (concern) under law of Russia and Germany. The author describes antimonopoly regulation in the European Union, Germany, and Russia. As the article is devoted to the analysis of antimonopoly regulation experience in Germany, the author pays attention to the problems of indirect control of construction of business-structures and realization of provisions concerning information disclosure for the purposes of antimonopoly regulation in the Russian Federation. In conclusion the author makes a proposal concerning the change of the current antimonopoly legislation of Russia.
