Rules regulating the universal jurisdiction in Russian law
Abstract
The main concern of the article is a universal jurisdiction and the scope of responsibilities of the courts of different states in terms of the transnational prosecution of the international crimes. Based on the historical, comparative legal analysis and assessment of the law enforcement practice it systematizes the national rules in Russian law of universal jurisdiction within the territory principle. In addition, it assesses the APC of the RF, which suggests an additional rule in regulating the universal jurisdiction to establish its legal relation with the court of the prosecuting country without any restrictions.
