Peculiarities of the legal status of a qualified investor
Abstract
In 2008 the legislation was enacted to define the notion of a “qualified investor”, the list of persons who can be referred to qualified investors by law as well as the basic principles according to which legal and natural persons can be recognized as qualified investors provided that they can demonstrate their compliance with certain requirements. The article examines the legal status and the procedure of recognition as qualified investors. The article highlights the legal aspects of securities and derivative financial instruments for qualified investors. The author provides an overview of changes in legislation related to the new category of investors.
