New Special Powers of the Italian State (Decree No 56/2012) in the Sphere of Protection of “Strategic Assets”, Vehicles and Communications Owned by Energy Providers
Abstract
The article is devoted to the special powers of the Italian government in the sphere of protection of “strategic assets”, energy, transport and communications companies. The author analyses the previous Italian rules on the “golden share”, that is special powers in private companies, as well as the judgment of the European Court of Justice according to which certain legislative provisions contradicted the principles of the Treaty on the Free Movement of Capital.
