Methodological problems in establishing a causal relationship when investigating rash of crimes committed by medical personal
Abstract
Judicial and investigative practice shows that identification of causal relations between acts of medical personnel and consequences is a complicated problem. The criminalistics aspect of identification of iatrogenic offense mechanism and causation are characterized in terms of on elementwise and factor analysis of all circumstances of the iatrogenic crime event. The mechanism of iatrogenic process includes items: a violation of the rules of medical care, an iatrogenic defect, Iatrogenesis and its immediate cause of the occurrence. The items have no independent meanings for criminal law, but they are important elements in determining a cause-effect relationship between a medical act and socially dangerous consequences in the form of causing death or injury to health of the patient.
