The complainst mechanism under the UN Convention on the Rights of the Child (1989)
Abstract
This article examines the procedure of the application at the international level of a new legal mechanism – communication procedure to the UN Committee on the Rights of the Child. The effectiveness of this legal mechanism for the protection of children's rights in accordance with the third Optional Protocol to the Convention on the Rights of the Child of 1989, relating to a communications procedure, dated 19 December 2011 is revealed and proved. The positive aspects of accession to the pointed Optional Protocol are analyzed, mainly concluded in strengthening and supplementing existing national and regional mechanisms for the protection of the rights of children whose rights have been violated. Due to the fact that an important feature of the Protocol is enabling the minors themselves to apply to the Committee of children rights, this article shows the characteristics of international legal regulation of this issue compared to other contractual mechanisms for the protection of human rights.
