Peculiarities of Jewish Legal System: Comparison by Example of Jewish and Muslim Law
Abstract
The present article considers the peculiarities of Jewish legal system in the Middle Ages in comparison with the classical Muslim legal doctrine. The carried out analysis of Jewish sources and their comparison with the Muslim legal doctrine show substantial similarity of Talmudic rabbinical thought with the Muslim legal doctrine. However the influence on the level of terms and some ideas only emphasizes, sets off the peculiarity, ideographic character of every legal system. Thus, the peculiarities of Jewish legal system which were examined in this article by example of three principles have formed its identity, distinction from other normative structures of theological type and in the first place the distinction from Muslim medieval law.
