Concept, Essential Elements and Essential Conditions of Building Contract under Law of Great Britain

Abstract

The present publication is devoted to legal regulation and legal nature of the building contract under law of Great Britain. On the basis of the analysis of the current legislation and judicial practice of Great Britain the author of the article shows what English laws means by the building contract, examines the peculiarities of formation and conclusion of the building contract, essential conditions and essential elements of the building contract indispensable to conclude a valid building contract, and considers issues concerning the form of the building contract under law of Great Britain. The article gives a comparative analysis of the norms of English and Russian law on building contracts and the contract for construction work, respectively.
