Abstract

The article is concerned with one of the urgent problems of foreign investment legislation in the RF, namely providing the guarantees to the foreign investors to nationalize their assets. It points out essential drawbacks of the current edition of the Article 8 of the Federal law dd. 09.07.1999 No, 160-FL «On foreign investments in the Russian Federation» considering the nationalization of the assets owned by the foreign investors in comparison with the norms and guarantees as laid out in the previous law on the foreign investments. In addition, it highlights the norms that regulate the reimbursement of losses incurred to the foreign investors and hidden nationalization.
