The development of legal science with regard to researching issues relating to normative regulation of sport

In this article, the author analyzes certain issues relating to the development of legal science with regard to researching problems relating to normative regulation of sport. The author notes that a small number of scientific papers are prepared on the topics, which do really relate to the nature of the sport. According to the author, it is necessary to distinguish the key relations forming sport (training and competitive relations) from those that are in any manner connected with it and come with it. The ability to distinguish the main and the secondary makes it possible to correctly direct the vector of scientific research. Unfortunately, today the phenomena that are unique for sport (for example, the normative nature of the right to participate in a sporting competition, the development and introduction of objective criteria for applying for competitions) still remain unresearched. The article substantiates the necessity of introduction of new scientific speciality 12.00.16 “Sports law”. The author believes that modern sports crisis is associated with the weak development of sports science. Lack of necessary research relating to normative regulation of sport is due to the following: (1) the existing Classification of scientific specialities does not refer to “Sports law” as a separate scientific speciality; (2) there are no specialized scientific journals as needed; and (3) the bulk of the journals contained in the respective List of the State Commission for Academic Degrees and Titles do not want to publish papers on issues relating to sports law. The author suggests introducing a new scientific speciality 12.00.16 “Sports law” and considering the establishment of new specialized journals, which would publish papers on issues relating to normative regulationof sport.
