Delimitation of jurisdiction between the International Criminal Court (ICC) and national courts
Abstract
The article considers the question of the delimitation of jurisdiction between the International Criminal Court (ICC) and national courts. In the first part author analyses norms of the ICC Statute, related to this question, and came to the conclusion that if a dispute arises between the ICC and state concerning jurisdiction it is the ICC that will take final decision and not the state or some third party. In the second part author looks at concrete cases in the ICC and points out that only in two of them the ICC had to consider the question of the delimitation of jurisdiction between him and state.
