Resource saving technologies and materials as intellectual property in the field of innivation: the Russian Federation VS the USA
Abstract
Intellectualization of the main factors of production as defining inevitability of the formation of an innovative type of management is accompanied by an intensification of involvement in the economic circulation of scientific and technological activity results and it makes the special importance of intellectual property right. The economic relevance of the corresponding legislative sector, as well as empirical analysis of the authors’ practical activity determined the study, appealing to the process of national lawmaking of this civil institute. By the example of the national economic entity of LLC"GRUS" implementing high-tech manufacturing, including nanomaterials, the study focuses on the relation of the exclusive authors and investors’ rights in innovative cross-border cooperation. The civil legislation novellas relating to the registration of intellectual property, as well as to the special legal regime of subinventions, utility models and industrial designs are commented. The problem of foreign patenting of domestic research and development results, estimated to export, is studied and the ways to solve it are identified.
