International legal regime of the seabed of the Arctic Ocean. The problem of delimitation
Abstract
The subject of the research is International legal regime of the Arctic Ocean with emphasis on the importance of customs in addressing the pressing issues of his distinction. The purpose of the research is modernization of the modern International legal position of the Russian Federation in relation to the limits of the Continental Shelf in the Arctic Ocean. A comparative analysis of existing legal mechanisms to identify the limits of the Continental Shelf: delimitation and its methods that have the force of customs (Sectoral method or Meridian lines), and also based on article 76 of the UNCLOS “delineation” of the Shelf in favour of the International Seabed Area. It is concluded that the existing International legal regime of the Seabed Arctic Ocean, including the custom of sectoral division of the Arctic spaces, will allow Russia to reach a fair result in the delimitation of the Arctic Continental Shelf with neighbouring States without the submission to the Commission on the Limits of the Continental Shelf on the basis of agreements delimitation, avoiding disputes, undue spatial concessions and ensuring national interests.
