Jurisdictional immunity of classification societies when acting on behalf on the flag states
Abstract
This article is dedicated to the analysis of legal nature of activities performed by classification societies on behalf of flag states and the issue whether classification societies can be granted jurisdictional immunity acting in such capacity. The provisions of European Convention on State Immunity, 16 May 1972 and United Nations Convention on Jurisdictional Immunities of States and their property, 2 December 2004 are analyzed. Authors identify similarities and distinctive features of the Federal law «About Jurisdictional Immunities of the Foreign State and Property of the Foreign State in the Russian Federation» and the United Nations Convention on Jurisdictional Immunities of States and their property. It is emphasized that statutory surveys and certification performed by maritime administrations or classification societies on their behalf constitute a specific activity related to the state’s sovereign prerogatives.
